1. Acceptance of Terms

By downloading, accessing, or using the Swome application or website (“the Service”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding agreement between you and Swome. We reserve the right to update these Terms at any time, with notice provided via the app or email.

2. Eligibility

You must be at least 18 years old to use the Service. By using Swome, you confirm that you meet this requirement. We reserve the right to terminate accounts where this condition is not met.

3. Your Account

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Ensuring your account information is accurate and up to date

You must notify us immediately at support@swome.app if you suspect any unauthorised use of your account.

4. The Pairing Feature

Swome allows users to “pair” accounts to share and compare property shortlists. By pairing with another user:

• You consent to sharing your saved properties and swipe activity with that user
• You accept responsibility for who you invite to pair with your account
• Either party may disconnect the pairing at any time through the app settings

Swome is not responsible for any disputes arising between paired users.

5. Property Listings

Swome aggregates property listings from estate agents operating in Northern Ireland. Regarding listings:

• We do not guarantee the accuracy, completeness, or availability of any listing
• Listings are provided for informational purposes only
• Swome is not a party to any property transaction
• All enquiries about specific properties must be directed to the relevant estate agent
• Listing information may be subject to change without notice

We make reasonable efforts to keep listings current but cannot guarantee real-time accuracy. Always confirm details directly with the listing agent before making any decisions.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse-engineer, scrape, or copy the Service or its content
• Use automated tools to access or interact with the Service
• Harass, abuse, or harm other users
• Post or transmit any false, misleading, or fraudulent content
• Attempt to gain unauthorised access to any part of the Service or its infrastructure

Violation of these terms may result in immediate account suspension or termination.

7. Intellectual Property

All content, branding, software, and design elements of the Service are the intellectual property of Swome or its licensors. You may not reproduce, distribute, or create derivative works without our express written permission.

Property listing content (descriptions, images, addresses) remains the property of the respective estate agents and is displayed under implied licence for the purpose of property search.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that:

• The Service will be uninterrupted or error-free
• Listing data will be accurate, complete, or current
• The Service will meet your specific requirements

9. Limitation of Liability

To the fullest extent permitted by law, Swome shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to:

• Reliance on inaccurate or outdated listing information
• Loss of data or account access
• Any property transaction entered into as a result of using the Service

Our total liability to you for any claim shall not exceed the amount you have paid us in the preceding 12 months (which, for a free service, shall be nil).

10. Third-Party Links and Services

The Service may contain links to third-party websites or services, including estate agent websites. We are not responsible for the content, privacy practices, or terms of any third-party services. Use of third-party services is at your own risk.

11. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or for any other legitimate business reason.

You may delete your account at any time through the app settings. Upon deletion, your data will be handled in accordance with our Privacy Policy.

12. Governing Law

These Terms are governed by the laws of England and Wales (which apply in Northern Ireland for contract purposes). Any disputes shall be subject to the exclusive jurisdiction of the courts of Northern Ireland.
